LEGAL TERMS AND CONDITIONS OF THE ‘‘BILASTINE REAL CLINICAL CASES CHALLENGE- NIGERIA’’ CONTEST

1. Organising Entitiy

FAES FARMA, S.A., with Tax Identification Number (CIF) A48004360 and registered office at Avenida Autonomía 10, 48940 Leioa (Bizkaia), Spain (hereinafter referred to as “FAES”), is the organizer of the contest entitled “Bilastine Real Clinical Cases Challenge - Nigeria” (the “Contest”), carried out through its subsidiary, FAES FARMA NIGERIA LIMITED and governed by these legal terms and conditions (the “Terms”).

2. Contest Period

FAES reserves the right to extend the Contest Period. Any such extension shall be duly communicated through the platform www.bilastine.ng .

3. Eligibility Criteria

Participation in the Contest is open to individuals who meet all of the following requirements (each a ‘‘Participant’’) :
• Be a licensed practising medical doctor of any specialty and/or a medical resident at any stage of training ;
• Be registered on the platform ;
• Be at least 18 years of age on the start date of the Contest ;
• Accept these Terms ;

Entries that fail to include the required information or that contain incorrect data shall not be accepted. In the event that the personal data provided is false, incomplete, or outdated, FAES reserves the right to withhold the prize from the relevant Participant.

FAES also reserves the right to verify the actual identity of Participants by any means it deems appropriate in order to ensure compliance with the eligibility criteria and to prevent duplicate entries. FAES may disqualify any Participant who fails to meet the requirements or submits duplicate entries.

4. Contest Procedure

4.1. Registration process

Participants must access the platform www.bilastine.ng and register by completing the required fields and accepting these Terms.

The period of submitting claims shall be end by 20 days after the conclusion of the Contest period.

4.2. Contest Mechanics

To participate in the Contest and be eligible for the prizes referred to in Section 4.4, Participants must submit one or more clinical cases describing real-life clinical scenarios in which patients were treated with antihistamines. Each case must include a description of the pathology, its impact on the patient’s quality of life, the various prescribed treatments, and the outcome of the intervention, without disclosing the identity of the patient(s) or any personal data that may lead to their identification
Participants may submit as many clinical cases as they wish. However, no clinical case that has already been published in any scientific journal (or similar publication) or is currently under review for publication shall be accepted.
In accordance with the provisions of Section 5 below, FAES may disseminate or publish any of the clinical cases submitted to the Contest, including, but not limited to, in scientific journals or similar media.
To be considered valid, all clinical case submissions must be received before the end of the Contest Period.

4.3. Jury

An independent jury composed of the following medical professionals shall be appointed to determine the awarding of prizes to the Participants :

For the sake of transparency and to ensure the independence of the jury members, each clinical case will be assigned a code so that the jury will not have access to the identity of the Participants.

4.4. Prizes

4.4.1 Description of the Prizes

A total of two prizes shall be awarded, with one prize allocated to each category (hereinafter, the “Prizes”, and each individually referred to as a “Prize”), each of which shall consist of the following:

  • Prizes :
    • (i) registration for the two winners to attend the 2026 European Academy of Allergy and Clinical Immunology (“EAACI”) Congress, to be held in Istanbul (Turkey), either in-person or virtually (the “Congress”);
    • (ii) one (1) airline ticket to the Congress venue, subject to the conditions described below;
    • (iii) three (3) nights of hotel accommodation at a hotel selected by FAES, under the conditions set forth below.
    • The registration fee for the event is public and accessible.

    Airfare conditions :The airline ticket (including taxes and fees) included in this Prize shall have a maximum value of 1500 euros; in economy class.

    Hotel accommodation conditions :Accommodation will be provided for one (1) person in a single room, excluding breakfast and any additional services, which must be paid for by the winner. The hotel will be selected by FAES, a four-star hotel.


  • FAES shall manage the entirety of the First Prize, including Congress registration, flight booking, and hotel accommodation. In order to claim the prize, the selected Participant must sign a Conflict-of-Interest declaration. Failure to provide this duly signed document will result in the forfeiture of the prize.

4.4.2 Conditions of the Prizes

The Prizes do not include any expenses other than those described in Section 4.4.1 above.
For the avoidance of doubt, the Prizes do not cover per diem allowances, or any other costs incurred in connection with attendance at the Congress.
Prize winners must provide FAES with the necessary information and data to facilitate the timely management of the Prizes.
The Prizes shall not be subject to modification, alteration, or any form of compensation.
The Prizes shall not be transferable to any third party.
Likewise, winners may choose to decline the Prizes awarded to them; however, no alternative prize will be offered, nor shall such renunciation give rise to any compensation or indemnity.

4.4.3 Prize Winners

The jury members, applying medical and clinical criteria, shall select six (6) winning Participants from among all clinical cases submitted to the Contest that comply with these Terms. Two third prizes, two second prizes, and two first prizes will be awarded. Accordingly, the Participants awarded first place shall receive the First Prize; those awarded second place shall receive the Second Prize; and those awarded third place shall receive the Third Prize.

4.4.4 Notification of Winners and Prize Delivery

Winning Participants will be notified by email of their selection, including the position awarded and the corresponding Prize. They shall have ten (10) calendar days from receipt of the notification to contact FAES and confirm all required information.
Should a winning Participant fail to claim their Prize within the specified period, they shall forfeit their right to receive the Prize.
The Prizes will be delivered by email or by any other method chosen by FAES.
To receive the Prize, winners must comply with all provisions set forth in these Terms and shall sign a conflict of interest declaration provided by FAES.

5. Intellectual Property

By merely participating, the Participant represents and warrants that they are the author or the legitimate holder of the moral rights and intellectual property rights of the clinical cases submitted to the Contest, and hereby grants FAES an exclusive, royalty-free license to all intellectual property rights that may arise from the clinical cases presented, including, without limitation, the rights of reproduction, adaptation, distribution, and public communication.
FAES shall hold the ownership of such rights for the entire legal duration thereof, with territorial scope limited to all countries where such rights are protected.
Notwithstanding the foregoing, FAES acknowledges and respects the moral rights inherent to the author(s) of the clinical cases.
Based on the aforementioned assignment of rights, FAES shall be entitled to use any information contained in the clinical cases submitted to the Contest as it deems appropriate, regardless of whether the case was awarded a Prize, including, but not limited to, publication and dissemination by any means.

6.Personal Data Protection

Participants in the Contest are hereby informed that all communications with Faes, either directly or through FAES FARMA NIGERIA LIMITED y/o CLIENTELIS, acting as a data processors of the Participant’s personal data, shall be conducted exclusively through the platform […]. Such communications shall be governed by the privacy policy of the aforementioned platform as well as by the provisions set forth in this clause.

B) Purposes, Legal Basis and Retention of Personal Data Processing
Purpose: To manage the Contest and send the prize to the winners.
Legal basis: Performance of the Contest.
Retention: For the period required by applicable law.

Recipients of Personal Data
The personal data of Participants shall be communicated to FAES FARMA NIGERIA LIMITED and/or CLIENTELIS, for the purpose of organizing the Contest, as well as to group companies located in Spain and to service providers, where necessary and to the extent required to ensure the proper execution of the Contest.

D) Rights in Relation to Personal Data
Participants may exercise the rights outlined in this section by submitting a request to FAES at the address specified at the beginning of these Terms and Conditions, or by sending an email to rgpd@faesfarma.com, attaching a copy of their national identity document.
Participants may withdraw their consent at any time. They are also hereby informed that they may exercise the following rights:
· Right of access to personal data. Any individual shall have the right to obtain confirmation as to whether FAES is processing personal data concerning them, and, if so, to access such data and obtain a copy thereof.
· Right to rectification and/or erasure of personal data, where personal data are inaccurate, Participants shall have the right to request their rectification and/or their erasure.
· Right to restriction of processing, in such cases, personal data shall only be processed for the establishment, exercise, or defence of legal claims.
· Right to object to the processing of personal data, in such event, FAES shall cease processing the data, unless compelling legitimate grounds prevail or the processing is necessary for the establishment, exercise, or defence of legal claims.
· Right to data portability Participants shall have the right to receive the personal data provided to FAES in a structured, commonly used and machine-readable format, and to have those data transmitted to another controller of their choice.
In the event of any dispute with FAES regarding the processing of personal data, Participants may lodge a complaint with the relevant data protection authority. In Nigeria, the competent authority is the Nigeria Data Protection Commission- https://ndpc.gov.ng/ .

E) Personal Data of Third Parties
With regard to personal data relating to third parties, Participants are reminded of the importance of respecting their privacy and must exercise special care when disclosing such data. As a general rule, users may only authorise the processing of their own personal data, not those of third parties. The disclosure of personal data relating to third parties shall be deemed a data transfer under applicable data protection law.
In the event that Participants provide personal data belonging to third parties, they shall be solely responsible for having obtained the prior and express consent of the data subjects to use and disclose such data to FAES, and for informing them of the inclusion of their data in FAES’s systems.

F) What Happens if You Do Not Consent to the Processing of Your Data?
If a Participant fails to provide the personal data required to enter the Contest, they shall not be allowed to participate. Similarly, if a Participant is selected as a winner and does not provide the required contact details, FAES shall not be able to deliver the Prize.

G) Updating Your Personal Data
By voluntarily providing personal data, Participants warrant that they are authorised to do so and that the information submitted is accurate, truthful, and up to date. In order to ensure that personal data remain current, Participants must notify FAES of any changes. Otherwise, FAES shall not be held liable for the accuracy of the data.

7. Acceptance and Filing of the Terms and Conditions

These Terms and Conditions shall be available for consultation on the platform www.bilastine.ng .
Participation in this Contest implies that the Participant has read, understood and fully accepted, without reservation, these Terms and Conditions, as well as any specific or special conditions that may supplement, amend or replace them with respect to certain aspects of the Contest. It also implies acceptance of the criteria reserved by FAES to resolve any matters arising from this Contest. Any statement to the contrary by the Participant shall result in their exclusion from the Contest, and FAES shall be released from any obligation undertaken with such Participant.
The illegality, invalidity, or unenforceability of any provision of these Terms and Conditions shall not affect the validity or enforceability of the remaining provisions, provided such remaining provisions are not fundamentally affected. For the purposes of this clause, “fundamentally affected” shall mean any situation that impacts the core purpose of these Terms and Conditions. Any such provision shall be replaced or supplemented by another that, while compliant with applicable law, serves the same purpose as the provision it replaces.

8. Liability

FAES, as well as any company involved in this Contest, shall not be held liable for any losses, damages, thefts, delays or other circumstances attributable to third parties or to the Internet that may affect or result from the use of the microsite and/or participation in the Contest.
By participating in the Contest, each Participant agrees, to the fullest extent permitted by law, to expressly hold harmless FAES and any company involved in this Contest from: (i) any claims and damages, whether direct or indirect, arising from or related to their participation in the Contest and/or the use of the Prize; and (ii) any damages or losses of any kind resulting from identity theft or impersonation by a third party in any form of communication.
FAES shall not be liable for any losses, delays or damages caused by circumstances attributable to third parties, nor for any incidents or events arising from force majeure or unforeseeable circumstances that may affect the implementation or execution of this Contest (including, for example, software or electrical failures, interruptions, or loss of Internet connection).
FAES shall be entitled to resolve any issues not expressly provided for in these Terms and Conditions.
FAES reserves the right to postpone, shorten, extend, modify, cancel or suspend the Contest due to force majeure or other circumstances beyond its control, and undertakes to inform the Participants of such circumstances as soon as possible.
Should any provision of these Terms and Conditions be declared null or invalid, the remaining provisions unaffected thereby shall remain in full force and effect.

9. Participant Conduct. Exclusions and Limitations

The use of the Contest for fraudulent purposes, in connection with criminal offences or unlawful activities of any kind, or for any improper use (including breach of these Terms and Conditions or any applicable provision) is strictly prohibited.
FAES shall not be held liable for any fraudulent or improper use of the Contest by Participants. FAES reserves the right to exclude any Participant who misuses the Contest, engages in fraudulent acts, or causes harm to other Participants.
Should FAES, or any entity professionally linked to this Contest, detect any irregularities or suspect that a Participant is obstructing the proper conduct of the Contest or engaging in any fraudulent acts that compromise the Contest’s transparency, FAES reserves the right to exclude all Participants who have directly or indirectly benefited from such fraudulent actions. Furthermore, FAES may pursue all civil and criminal actions applicable.

10.Governing Law and Jurisdiction

These Terms and Conditions shall be governed by Spanish law.
For any dispute arising from the interpretation or application of these Terms and Conditions, or in any way related to them, Participants hereby submit to the courts and tribunals of Bilbao (Bizkaia), expressly waiving any other jurisdiction to which they might be entitled.
